Under this law, \u201cAny person who feloniously steals, takes, carries, leads, or drives away the personal property of another, or who shall fraudulently appropriate property which has been entrusted to him or her, or who shall knowingly and designedly, by any false or fraudulent representation or pretense, defraud any other person of money, labor or real or personal property, or who causes or procures others to report falsely of his or her wealth or mercantile character and by thus imposing upon any person, obtains credit and thereby fraudulently gets or obtains possession of money, or property or obtains the labor or service of another, is guilty of petty theft.&#8221; That person would then <a href=\"https:\/\/www.monderlaw.com\/\/\">need a lawyer to help<\/a> them defend against the charges.<\/p>\n<h2>What qualifies as petty theft?<\/h2>\n<p>Basically, to convict someone of PC 484(a), the prosecutor must prove each of the following elements:<\/p>\n<ol>\n<li>The defendant\u00a0took possession of another&#8217;s property;<\/li>\n<li>The\u00a0defendant did so without the owner&#8217;s permission;<\/li>\n<li>The defendant intended to deprive the owner of the property permanently;<\/li>\n<li>The defendant moved the property.<\/li>\n<\/ol>\n<h2>Petty Theft is a Misdemeanor<\/h2>\n<h3>Misdemeanor Petty Theft\u00a0Penalties<\/h3>\n<ul>\n<li>A maximum sentence of 6 months in county jail;<\/li>\n<li>A fine of up to $1,000;<\/li>\n<li>Informal probation.<\/li>\n<\/ul>\n<p>It is important to note that if the accused has no <a dir=\"ltr\" lang=\"en-US\" href=\"https:\/\/www.monderlaw.com\/\/pratice-areas\/theft\" target=\"_self\" rel=\"noopener noreferrer\" hreflang=\"en\">prior convictions for theft<\/a>,\u00a0a petty theft of property having a value of $50 or less may be charged as a mere infraction and will be punishable by a fine of not more than $250.<\/p>\n<h2>What are the consequences of a petty theft conviction?<\/h2>\n<h3>Short Term Consequences:<\/h3>\n<p>In most instances, shoplifting or petty theft is a misdemeanor, or a low-level offense. The punishment or sentence for misdemeanors is usually a fine, a few days in jail or both. For example, a typical law may state that \u201canyone convicted of petty theft shall be fined no more than $500, incarcerated for no more than 30 days, or both.\u201d It\u2019s usually up to the judge to decide if which sentence you\u2019ll get. He\u2019ll consider things like the value of the property and whether it\u2019s your first offense. Someone whose first offense is stealing $100 worth of merchandise from a store will likely get a lighter sentence than someone who steals the same merchandise but has a prior theft conviction, for instance. Also, the defendant will usually be ordered to give back what he took, or its value, if he doesn\u2019t have it any more. This is called restitution.<\/p>\n<h3>Long-Term Consequences:<\/h3>\n<p>A conviction for shoplifting is just like any other criminal conviction: You\u2019ll have a criminal record that may follow you for the rest of your life.
