Depending on the facts of the case, a person can commit extortion by threat or force to compel another person to give up money, property, or perform an act.<\/p>\n<h2>How can the prosecutor prove someone committed extortion in San Diego?<\/h2>\n<p>Basically, to convict someone of PC 518, the prosecutor must prove each of the following elements:<\/p>\n<ol>\n<li>The defendant threatened to unlawfully injure, accuse, or expose another person;<\/li>\n<li>When making the threat or using force, the defendant intended to use fear to obtain compliance;<\/li>\n<li>As a result of the threat, the person consented to the defendant&#8217;s demands.<\/li>\n<\/ol>\n<h2>Extortion is a Felony<\/h2>\n<p>Felony extortion\u00a0is punishable by two, three, or four years in the state prison and a maximum fine of $10,000. Moreover,\u00a0an attempted extortion conviction may be punished in almost the same manner as if the attempt had been successful. Attempted extortion carries a maximum county jail sentence of one year, a state prison sentence of 16 months, or two, or three years, and the same maximum $10,000 fine.<\/p>\n<h2>Extortion in San Diego and Related Offenses<\/h2>\n<h3>Burglary<\/h3>\n<p>California Penal Code section 459\u00a0defines burglary as entering a structure with the intent to commit theft or any felony once inside. Bribery too\u00a0consists of an\u00a0illegal attempt to obtain money, property, or acts from someone else.<\/p>\n<h3>Robbery<\/h3>\n<p>California Penal Code section 211\u00a0defines robbery\u00a0as taking\u00a0property from another person, against their will, by the use of force or fear. Robbery\u00a0is related to extortion because the two offenses have\u00a0similar elements. Robbery too consists of taking money\u00a0from another using force or fear. The difference between the two offenses is that for extortion the victim must consent to give up the money.
