Anything you say can and will be used against you in a court of law. You have the right to talk to a lawyer and have him present with you while you are being questioned. You can decide at any time to exercise these rights and not answer any questions or make any statements.\u201d<\/span><\/i><\/p>\n<p><span style=\"font-weight: 400;\">Thanks to the powers of American cinematography, virtually every living person knows the Miranda Rights by heart. What many don\u2019t know &#8211; and this includes US citizens &#8211; is when and how these rights actually apply.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">As every good <\/span><span style=\"font-weight: 400;\">criminal attorney in San Diego<\/span><span style=\"font-weight: 400;\"> will tell you, Miranda Rights are actually conditional. They do not apply in every situation and to every person, which often comes as a surprise to those who expect a \u201cTV-style\u201d reading in the moment of the arrest.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">For these reasons, understanding the scope and limitations of Miranda is essential for anyone wishing to know how the US justice system really works, and not just a polished (and lackluster) TV version.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">What are Miranda rights?<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Stemming from the 1966 U.S. Supreme Court case \u201c<\/span><a href=\"https:\/\/guides.loc.gov\/latinx-civil-rights\/miranda-v-arizona\"><span style=\"font-weight: 400;\">Miranda v. Arizona<\/span><\/a><span style=\"font-weight: 400;\">\u201d, the Miranda Rights are a constitutional warning that U.S. law enforcement officials must give to individuals before conducting a custodial interrogation. In doing so, the Miranda achieves a two-fold effect:<\/span><\/p>\n<ol>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Protects the person&#8217;s constitutional rights (i.e., Fifth Amendment right against self-incrimination and Sixth Amendment right to legal counsel);<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Ensures that any statement the suspect gives is truly voluntary (i.e., not coerced).<\/span><\/li>\n<\/ol>\n<h2><span style=\"font-weight: 400;\">What triggers Miranda?<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Miranda warning is required when both of the following conditions are met:<\/span><\/p>\n<ul>\n<li aria-level=\"1\"><b>Custody<\/b><span style=\"font-weight: 400;\">: The person is deprived of freedom in a significant way. This is not limited to being arrested only &#8211; it applies to any situation where a person is not free to leave.<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Interrogation<\/b><span style=\"font-weight: 400;\">: Law enforcement uses actions that are reasonably likely to elicit an incriminating response from the suspect.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Note that, if only one condition is met (e.g., custody without interrogation or vice versa), Miranda does not apply.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">How does Miranda work?<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">In general, the process follows this pattern:<\/span><\/p>\n<ol>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">If the <\/span><b>suspect is both in custody and subject to direct questioning<\/b><span style=\"font-weight: 400;\"> (or equivalent) by law enforcement, then;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Officers must inform the suspect of their Miranda rights<\/b><span style=\"font-weight: 400;\"> before the questioning begins.\u00a0<\/span>\n<ol>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Otherwise, any incriminating statements made are generally inadmissible in court.<\/span><\/li>\n<\/ol>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The suspect can then either<\/span>\n<ol>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><b>invoke their rights<\/b><span style=\"font-weight: 400;\"> (remain silent or request a lawyer) or<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><b>waive them knowingly and voluntarily<\/b><span style=\"font-weight: 400;\">.<\/span><\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">Point #3 is where the Miranda rights confuse most people: believing that they completely prevent law enforcement from questioning a suspect. This is simply not the case &#8211; all they do is set the rules for when and how the statements can be used in a court of law.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">What is the exception to the Miranda warning?<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">There are several, but the most notable one is the public safety exception, established in New York v. Quarles (1984), which states that:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Law enforcement may interrogate the suspect without giving Miranda warning if there\u2019s an immediate threat to public safety.
