As for the reasons why &#8211; that\u2019s what we\u2019re exploring today.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">What happens if you don&#8217;t register as a sex offender in California?<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Under <\/span><a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/codes_displaySection.xhtml?lawCode=PEN&amp;sectionNum=290.018\"><span style=\"font-weight: 400;\">California Penal Code \u00a7290.018<\/span><\/a><span style=\"font-weight: 400;\">, failing to register as a sex offender is a criminal offense and is taken with grave seriousness by the courts, with the severity of the punishment being determined primarily based on:<\/span><\/p>\n<ol>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The nature of the original sex crime<\/span><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">AND<\/span><\/p>\n<ol>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Whether the failure to register was a first-time or repeat offense.<\/span><\/li>\n<\/ol>\n<h3><span style=\"font-weight: 400;\">What is the punishment for failing to register as a sex offender in California?<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">As discussed in our previous articles, <\/span><a href=\"https:\/\/www.monderlaw.com\/\/news\/what-sex-offender-registration-california-penal-code-pc-290\/\"><span style=\"font-weight: 400;\">California\u2019s Sex Offender Registration Act<\/span><\/a><span style=\"font-weight: 400;\"> (Penal Code \u00a7290 et seq.) gives individuals convicted of qualifying sex offenses a <\/span><a href=\"https:\/\/www.monderlaw.com\/\/news\/what-california-senate-bill-sb-384-sex-offender-tier\/\"><span style=\"font-weight: 400;\">very limited window to (re)register with local law enforcement<\/span><\/a><span style=\"font-weight: 400;\">. If they fail to do so, the offender may face the following consequences:<\/span><\/p>\n<h4><span style=\"font-weight: 400;\">1. Misdemeanor or Felony Charges<\/span><\/h4>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">(CA PC \u00a7290.018(a)) If the original sex offense was a misdemeanor, failure to register is typically charged as a misdemeanor.<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><b>Penalty<\/b><span style=\"font-weight: 400;\">: Up to 1 year in county jail and\/or a fine up to $1,000.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">(CA PC \u00a7290.018(b)) If the original conviction was a felony, then failure to register is charged as a felony.<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><b>Penalty<\/b><span style=\"font-weight: 400;\">: 16 months, 2 years, or 3 years in state prison, and\/or a fine up to $10,000.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h4><span style=\"font-weight: 400;\">2. Probation or Parole Violation<\/span><\/h4>\n<p><span style=\"font-weight: 400;\">Failing to register is considered a violation of probation or parole, which can trigger:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Penalty: <\/b><span style=\"font-weight: 400;\">Revocation, mandatory incarceration (up to 90 days), or renewed parole conditions (pursuant to PC \u00a7290.018(c), (e))<\/span><\/li>\n<\/ul>\n<h4><span style=\"font-weight: 400;\">3. Strike Under California\u2019s Three Strikes Law<\/span><\/h4>\n<p><span style=\"font-weight: 400;\">If the original sex crime was a serious or violent felony (e.g., rape, lewd acts with a minor, etc.), than a felony conviction for failing to register can be considered a &#8220;strike&#8221; offense. Accumulating multiple strikes can lead to:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Penalty:<\/b><span style=\"font-weight: 400;\"> Enhanced sentencing, including 25 years to life in prison under the Three Strikes Law.<\/span><\/li>\n<\/ul>\n<h4><span style=\"font-weight: 400;\">4. Repeat Offenders<\/span><\/h4>\n<p><span style=\"font-weight: 400;\">Individuals with <\/span><b>prior convictions<\/b><span style=\"font-weight: 400;\"> for failing to register can face:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Penalty:<\/b><span style=\"font-weight: 400;\"> Enhanced sentencing, including longer jail or prison times, increased fines, and fewer chances for probation.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">In addition, courts may impose habitual sex offender sentencing, which carries a minimum sentence of 25 years to life (pursuant to PC \u00a7667.71)<\/span><\/p>\n<p><b><i>A critical thing to note here<\/i><\/b><span style=\"font-weight: 400;\"> is that the second and every subsequent offense can be and often is charged as a felony &#8211; even if the original offense was a misdemeanor.
